Enabot Service Agreement for Users
Dear users:
Welcome to use Enabot products and services!
The following clauses of the Enabot Service Agreement for Users are legally binding agreement
between you and Fuzhi Science and Technology (Shenzhen) Co., Ltd. (hereinafter referred to as
“Enabot”).
Before using Enabot products and services, you shall read Enabot Service Agreement for Users
(hereinafter referred to as “the Agreement”) and Enabot Privacy Policy, please carefully read and
fully understand clauses herein, especially those concerning exemption or restriction of Enabot’s
liability, dispute resolution, and applicable law. Please prudently read and choose whether to
accept the Agreement or not (minors shall read in the presence of a legal guardian). Your
downloading, installing, and using the software, obtaining an account, and login shall be deemed
as your acceptance of the Agreement, clauses of which shall be binding on you.
The Terms expressly state your legal liability and rights when using Enabot products, software,
services, and relevant websites (hereinafter referred to as “the Service”). In the Terms, “you”
means any individual who uses and visits the Service.
In order to provide better experience to you, you can fully use the Service only after agreeing on
clauses of the Enabot Service Agreement for Users, including Enabot Privacy Policy and any
agreement between you and Enabot (hereinafter referred to as “the Terms”). Please carefully read
the following clauses and tick the boxes at the end of them to express that you have read and
accepted them.
If you disagree on all or any part of the Terms, you cannot use the Service.
1. We respect and protect your personal data
Enabot respects and protects personal privacy of all users of Enabot products, and Enabot will not
voluntarily collect, disclose, transfer your personal information for registration (such as nickname
portrait, etc.) and your personal privacy such as audio, video, and picture, or provide them to any
third party unless agreed expressly by you or prescribed by compulsory provisions of laws and
regulations. Enabot will not use your audio, video, picture, and other data saved on the cloud for
other purposes, and such save of them on the cloud is only for realizing product functions and
ensuring data security.
2. Third-party service
Operators and third parties may provide products and services through Enabot platform, such as
third-party APP and service. When you choose a third-party product and service, it shall be
deemed that you accept the clauses of third-party service. Therefore, Enabot strongly advises you
to carefully read agreements and privacy policy of the third party in advance as Enabot has no
right or obligation to control or audit third-party products and services. Enabot will not bear any
liability on your interests damaged due to the use of a third-party product or service.
When you share to a third-party (QQ, WeChat, Microblog, FacEnabotok, etc.), your phone device
No., MAC address, and other device identifiers may be transmitted to the third party.
3. Authorization and collection of your data
For better improving product stability and providing personalized service, third-party entities
cooperating with Enabot may collect some information or data of your product. If you click “agree”
on the prompt when using function of taking photos or videos of EBO HOME APP or use EBO
HOME APP, it shall be deemed that you have agreed to authorize Enabot to collect and analyze
the following information of you: device information (such as operating system, device identifier,
language, type, and networking mode), client terminal information (such as version No., mark,
and time when users open/close client terminals), application information (such as error reporting
and service initiation), and video monitoring data (including but not limited to audio, video, and
picture). Under the circumstance where you agree to let a third party handle your information,
please follow Article 2 herein.
Personal information that you have expressly authorized Enabot to collect shall be handled
according to Enabot Privacy Policy, so please carefully read it.
4.Note for users
Software function: the software provides support to hardware devices, to ensure normal use of
hardware devices, promote new functions from time to time according to users’ requirement, and
provide convenient entrance for Wi-Fi access of mobile devices. The software has functions such
as real-time view, two-way vocal conversation, warning report, cloud video record, and device
sharing.
(1) Real-time view
After installing hardware devices, users can watch real-time situations (video and voice) within
the scope covered by cameras at any time through the client terminal of the software.
(2) Two-way vocal conversation
Microphones and speakers are installed in hardware devices. Users can carry out two-way vocal
conversation with the person at the other camera side from a long distance through mobile client
terminals of the software.
(3) Warning report
Hardware devices have warning report function, when any object moves or the voice is abnormal
within the area monitored by cameras, cameras will take photos and videos, and send warning to
the server, and then the server will send warning to mobile client terminals of users. The function
is only used as waring prompt. The dynamic photos or short videos of abnormality taken may be
incomplete or unclear and cannot be used as evidences.
(4) Cloud video record
Cloud video record is an optional additional service. After users open this function, they can
upload monitoring videos to the cloud server. Users can replay videos saved on the cloud server at
any time through this function.
(5) Device sharing
Users with administrator privileges can share devices to other users, managers can manage and
control specific permission of users.
(6) Voice detection
This function will detect voices in the environment, and the accuracy of detection results may be
affected by interference of outer environment, and the loudness and distance of voice. As this
function is only for experience, certain deviation is normal.
(7) Human detection
The function is now only applicable to home environment where the installation and use is normal,
and the accuracy of detection results may be affected by objects of outer environment, background,
and light. As this function is only for experience, certain deviation is normal.
(8) The software provides registration service, through which users can register Enabot accounts.
Enabot accounts are registered in Enabot account center by using the network service provided
there. Users shall agree on and follow Enabot’s Account Agreement for Users before registering
Enabot accounts.
(9) The software provides management service for Enabot accounts. When users return to the
software from WeChat, Microblog, Google, FacEnabotok, and other webpages, the software needs
users’ authorization to have access to address list only for confirming Enabot account login
situation and protecting users’ privacy in the software. The information of the address list will not
be collected.
(10) Link address and QR code generate by device sharing are security keys of the shared camera,
which shall be properly kept and distributed by users.
5. Upgrade, pause, suspension, or termination of service
Enabot keeps upgrading and improving the Service. In consideration of the specialty of
e-commerce activities and network service as well as the security of operation, you understand
and agree that Enabot may upgrade or adjust Enabot products and services at any time, which may
cause effects of some functions to change or old service systems unusable; upgrade or adjustment
will be published in forms of new version of services and renewal of systems. You understand and
agree that Enabot may regularly or irregularly check, repair, or maintain platforms or devices
supporting its services or change related the third-party it cooperates with, which may cause
suspension of services. You understand and agree that Enabot may partially or wholly terminate
services at any time. In addition, you are entitled to voluntarily terminate the Service by
deregistering accounts.
6. Risk and liability
(1) You shall bear the risks of using Enabot products. Enabot does not guarantee in any form that
services and their results will meet your requirements, services of products will not be suspended,
or services and data results are secure, accurate, timely, and legitimate. If you fail to normally use
Enabot products due to reasons of network situation, communication circuit, third-party webpage,
or service provider, Enabot shall not bear any legal liability. Unless otherwise stated, Enabot’s
services are free of charge. As for some services which need support of phone, data service, or
SMS functions, you may pay to third parties. Enabot will not voluntarily collect your personal
information, unless they are voluntarily provided by you.
(2) If the aforesaid contents which may concern your privacy or you consider as privacy are
divulged, discloses, or obtained, used or transferred by third parties due to your own actions or
force majeure, you shall bear all consequences and Enabot shall not bear any liability.
(3) You shall bear the cost of network caused by data synchronization to the cloud or local
terminal.
7. Copyright
Enabot and its licensor have complete intellectual property of the software. On the premise that
you obey laws, regulations, policies, and the Agreement, you can use the software according to the
Agreement. You are not entitled to and shall not do any of the following, including but not limited
to:
(1) Delete any copyright statement or prompt, and any other information of the software.
(2) Reserve engineering, assembly, or compilation the software.
(3) Use, copy, modify, lease, or assign the software partially or wholly beyond the scope of the
Agreement.
(4) Provide the software to any third party, permit others to use the software, or use the software
for purposes banned by Enabot (such as commercial purposes)
(5) Conduct the following actions on images and words of the software at will, including but not
limited to: use, copy, modify, link, forward, compile, publicize, publish, set up mirror site, or
develop related derivative products, works and services by virtue of the software.
(6) Exploit the software to save, publicize, and spread contents violating national laws,
regulations, and policies.
(7) Exploit the software to save, publicize, and spread contents infringing over others’ intellectual
property, trade secrets, and other legitimate rights.
(8) Carry out actions harming the security of computer network.
8. Version upgrade
Enabot will decide whether to upgrade the version of the software. If Enabot decides to provide
upgraded version of the software, the Terms shall apply to the upgraded version unless there is
another Service Agreement for Users replacing the old one. Your choice of upgrade shall be
deemed that you have expressly agreed to follow service terms of relevant software; if you
disagree on any contents of service terms, please do not choose upgrade.
9. Termination of rights
Invalidity of any clauses herein shall not affect the validity of other clauses. Enabot or its licensor
has the right to suspend or terminate the Agreement at any time. After the suspension or
termination of the Agreement, you shall immediately stop using the software and delete all
software and relevant materials that have been copied or installed.
10. Miscellaneous
All titles of clauses herein are only for convenience of reading and have no actual meanings, and
cannot be used to interpret the Agreement. If clauses herein become void or unenforceable, other
clauses shall remain valid and binding on both parties. The ownership and operation right of the
software belongs to Enabot.
The effective date of the Agreement: May 1, 2021
Fuzhi Science and Technology (Shenzhen) Co., Ltd. has the copyright and reserves the
interpretation right within the scope permitted by laws.
